Pinner USA, Inc. (“we” “us” “our” “Pinner” or “Company”) respects your privacy and we committed to protecting it through our compliance with this privacy policy (“Privacy Policy”). We have created this Privacy Policy to inform You, the user of our website and services, of our policies regarding the collection, use and disclosure of personal information and the choices you have associated with that information.

This Privacy Policy applies to all personal information hereinafter referred to as (“PI) collected during any use of our website (the “Site”) and all written, electronic, and oral communications, or, collected online or offline by us in regards to your use of the Site and all services provided by the Site (such services are collectively referred to as the “Services”). Your use of the Site shall be deemed to include, without limitation:

  • Any access to the Site via any mobile, web, console, desktop and other applications you download from this Site, which provide dedicated non-browser-based interaction between you and this Site.

  • You access us via our Health Consultants and Lab.

By using this Site, you consent to the collection and use of the Personal Information (“PI”) in accordance with this Privacy Policy and our Terms of Use. If you do not feel comfortable with any part of this Policy or our Terms of Use, you should not use or access our Services.

This Site is offered and available to users who are 18 years of age or older. We do not collect or maintain personal information from people we actually know are under 18 years old. If we obtain actual knowledge that a user is under 18 years old, we will use our best efforts to remove that person’s information from our database. If you are not 18 years of age or older, you must not access or use our Services.

New Controls

This privacy policy gives you and consumers who use our Site:

Any Personal Information that is collected under HIPAA/HITECH laws and regulations is information considered to be individually indentifiable information relating to the past, present, or future health status of an individual that is created, collected or transmitted or maintained by a HIPPAA covered entity in relation to the provision of healthcare, payment for healthcare services, or ue in helath care operations is protected by those laws . To the extent that the personal information collected is HIPPAA protected, it shall be protected as required.

The types of personal information that we may collect about you include, but are not limited to: the information you provide to us, information collected automatically about your use of our services, including our business partners. Our “business partners” are those Service Providers that provide services to us to enable us to operate the Site and our Services. All business partners/Service Providers are bound the terms of this privacy policy.

Information You Voluntarily Provide to Us. The personal information we collect on or through our Services may include:

Your Choices/Right to Opt Out/Right to Non-Disclosure

Notwithstanding anything in this Privacy Policty to the contrarty, this Site gives you the following power over your own Personal Information as follows:

  4. PORTABILITY:  You have the right to request that your personal information be sent and ported to another Company/controller by emailing _______.
  5. DELETION:RIGHT TO BE FORGOTTEN:  You have a right to have your personal information deleted by making such request to us by emailing info@pinnertest.com; the Company will delete your data after verification (with some exceptions) and has 45 days to comply with this request; Note: the Company does not have to comply with a deletion request if, a) it is providing goods and/or services to you b) it needs the information to detect and resolve issues related to security and/or functionality c) such information is necessary to comply with legal obligations d) the Company is conducting research in the public interest e) use of such information is an exercise of free speech or another’s right to free speech f) the information is being used for internal pruposes that the consumer might expect.
  6. RIGHT TO DATA SECURITY: You have right to have your personal data secure. The Company implements and monitors reasonable security measures, practices and procedures to keep your personal information secure.

There is no charge to you for acting on the foregoing rights.

Limitations to Your Rights/Control Over Personal Data:  Except if you are under the age of 16, you must actively Opt Out as there is no Opt In option except for individuals under the age of 16. The Company does not have to rectify errors in personal information. You have no right to restrict automated processing of personal information (except if under the age of 16). Except as stated otherwise herein, the Company retains the right to sell and transfer personal data to third parties to the extent permitted by law which varies from State to State.

Please note that we may disclose, without restriction, aggregated or anonymized information about our users, which is information that does not identify any specific individual.

  1. MARKETING COMMUNICATIONS

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

If you do not wish to have your email address or other contact information used by us to promote our own or third parties’ products or services, you can opt-out by logging into the Site and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending an email stating your request to  info@pinnertest.com. You may also choose to stop receiving our promotional or marketing communications by following the “unsubscribe” instructions included in these messages. This opt out does not apply to information provided by us as a result of a product purchase, warranty registration, product service experience or other transactions.

Please note that “opt-out” and “unsubscribe” requests may not take effect immediately and may take a reasonable amount of time to receive, process and apply, during which time your Information shall remain subject to the prior privacy settings. Additionally, you should be aware that any Information provided to third parties prior to your election to opt-out or unsubscribe will not be retrieved or rescinded, unless required by applicable law.

  1. KEEPING YOUR PERSONAL INFORMATION ACCURATE AND DELETION

We are committed to ensuring that your personal information is kept accurate and up to date. However, it is up to you to update it with any changes. You can review and change your personal information by logging into the Site and visiting your account profile page. You may also send us an email at info@pinnertest.com to request access to, or to correct any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you no longer wish to participate in our Services, or no longer wish to have your Personal Information be processed, you may request to delete your account and the information in your account, subject to certain limitations, by emailing us at info@pinnertest.com. Once you submit your request, we will send an email to the email address linked to your account requesting that you confirm your deletion request. Once you confirm your request to delete your account and data, your account will no longer be accessible while we process your request. Once you confirm your request, this process cannot be cancelled, undone, withdrawn, or reversed. When your account is deleted, all associated personal information is deleted.

If you delete your User Content from the Site, copies of your User Content may remain viewable in cached and archived pages, or might have been copied or stored by other Site users. Proper access and use of information provided on the Site, including User Content, is governed by our Visitor Terms of Use.

The opt out, right to non-disclosure and other provisions of this Agreement protect California residents under California law. .

Privacy Rights

If you are a California resident, you have rights in relation to your Personal Information; however, your rights are subject to certain exceptions. For instance, we cannot disclose specific pieces of Personal Information if the disclosure would create a substantial, articulable, and unreasonable risk to the security of the Personal Information, your account with us or the security of our network systems.

  • Right Against Discrimination – You have the right not to be discriminated against for exercising any of the rights described in this section. We will not discriminate against you for exercising your right to know, delete or opt-out of sales.
  • Right to Know – You have the right to request in writing: (i) a list of the categories of personal information, such as name, address, email address, that a business has disclosed to third parties during the immediately preceding calendar year for the third parties’ direct marketing purposes, and (ii) the names and addresses of all such third parties. In addition, you have the right to request: (i) the categories of personal information we have collected about you, (ii) the categories of sources from which personal information is collected, (iii) the business or commercial purpose for the information collection, (iv) the categories of third parties with whom we have shared personal information, and (v) the specific pieces of personal information we hold about an individual.   • Right to Delete – You have the right to request us delete any Personal Information we have collected from you or maintain about you, subject to certain exceptions.

To assert your right to know or your right to delete your Personal Information, please contact according to the “Contact Information” section below. To verify your identity, we may ask you to verify Personal Information we already have on file for you. If we cannot verify your identity from the information we have on file, we may request additional information from you, which we will only use to verify your identity, and for security or fraud-prevention purposes.

  • Right to Opt-Out of Selling. As described in this Privacy Policy, in certain situations we may share your Personal Information with our partners, third parties or affiliates for our marketing or other purposes as long as they are Service Providers. To the extent such sharing is considered a “sale” or transfer under the CCPA, as a California resident you have the right to opt-out of such sharing.
